Shelton <br />Director <br />M E M O R A N D U M <br />2b: Richard Stenzel, Division of Water Resou/r/c'es~ <br />FROM: Bob Liddle, bfined Land Reclamation /-~ <br />~V <br />DATE: April 6, 1982 <br />RE: Solicitation of Comments on Water Rights Bourg Mine, <br />Walden, Colorado: File C-021-81 <br />Attached is a copy of the Bourg Coal mine for your consideration of any <br />water rights concerns. We anticipate completing our review within 45 days. <br />This is a small coal mine located about 4 miles N.E. of Walden,Colorado. <br />They will be mining less than 100 acres over the next five-years. The mine <br />watershed is tributary to the Canadian River. <br />Hydrologic information is contained in Section I-1 through I-31. I have <br />copied the pages dealing specifically with water riyhts for your convenience. <br />The appropriate sections of the application have also been tabed. <br />I just want to mention two problems I identified: <br />1. You will note that the "pond summary" indicates that Pond 'C' <br />will stone 2.8 acre-feet of water in the sedimenC storage area of <br />the pond. The ponds will not store more than 2 acre-ft. <br />2. The applicant mentioned on page Z-3, Z-5, and I-31 that water stored <br />in Pond H will be used to augment if a call exists. Although this pond does <br />exist and is functional, Z doubt if any water will ever exist in the pond. <br />The stream is ephemeral and has little or no defined channel and has never <br />been seen Eo contain a surface flow. Therefore, if a call exists on the <br />Canadian River and no water is available in Pond H will the operator be <br />in violation of Water Law? If so, do you have any recommendations? <br />If you have any questions on the mine in general you may contact Mike Savage <br />of our Staff. He is the lead reviewer for our office.
