Dale Larsen, President <br />Peerless Resources, Inc. <br />5528 Indian Rock Road <br />Salt Lake City, Utah 84117 <br />Re: Coal Gulch Mine Permit Application - File No. C-084-067 <br />Dear Mr. Larsen: <br />The Division has reviewed your permit application for the Coal Gulch Mine, <br />received on August 30, 1984, and has found it incomplete. <br />The following items must be provided in order for the Division to continue its <br />review: <br />1) Rule 2.03.4(4) requires that any person identified under 2.03.4(2)(c) <br />(in this case Mr. L. Dale Larsen) must provide a statement of any current or <br />previous surface coal mining permits and of any pending permit applications. <br />Since Mr. Larsen is affiliated with the Durango Coal Company he must provide <br />the required information as it pertains to that company. <br />2) Rule 2.03.6 - Right of Entry requires a description of the documents <br />upon which the applicant bases his or her legal right to enter and begin <br />surface coal mining operations in the permit area. Exhibit 1 of the <br />application describing these rights for the Durango Coal Company, but makes no <br />mention of the applicant - Peerless Resources, Inc. <br />3) Rule 2.03.9 requires that as part of the permit application, a <br />certificate certifying that the applicant has a public liability insurance <br />policy in force for the surface coal mining and reclamation operation for <br />which the permit is sought shall be submitted. No certificate has been <br />provided. <br />4) The Department of Health Emission permit was issued to Arness-McGriffin <br />Coal Company. This permit shall not be transferred without approval of the <br />Air Pollution Control Division.
