Watcher <br />Re: Permit No. NI-77-376; Canyon Dolomite Quarry; Possible Violation for Failure tfi`eculiveDireclor <br />Protect the Hydrologic Balance M¢nael e. long <br />Division Director <br />Dear Mr. Flanders: <br />On February 8, 1999 the Division of Nl inerals and Geology conducted an inspection of your mine and found <br />A storage tank had leaked or discharged an unknown and potentially hazardous material onto the <br />ground within your permitted area thereby causing a poten[id hydrologic impact to the surface water <br />run-off. <br />The Division believes this is in violation of: <br />The Colorado Land Reclamation Act for the Extraction of Construction Materials, C.R.S. 34-32.~- <br />116(4)(h)and the regulations promulgated thereof, specifically, Rule 3.1.6 which requires the mine to <br />minimize disturbances to the hydrologic balance of affected land and surrounding area during and <br />after mining. <br />Therefore, the Division has found reason to believe a violation exists to Permit M-77-376 and the Law and <br />has scheduled this matter before the Ivtined Land Reclamation Board. <br />A Formal Public Hearing will be held during the March 24th and 25th, 1499 Board meeting for consideration <br />of possible violation(s)~The hearing will be held in Denver, Colorado at 1313 Sherman Street, Room 318, <br />beginning at 9:00 Alvt. both days. As the agenda for the meeting is fumed up, you will be notified as to what <br />day your item will be heard. It will be reiterated that there is reason to believe that you are in violation of the <br />provisions noted above. <br />If the Board finds a violation at this hearing, it may assess a civil penalty in the amount of $100.00 to <br />$1,000.00 for each day of violation.
