Watcher <br />Colorado Springs, CO 80960-0155 Eettulive Direcor <br />Michael8 Long <br />Division Director <br />Re: Permit No. M-77-376; Canyon Dolomite Quarry; Possible Violation for Failure to <br />Properly Post Mine Identification Signs and Affected Boundary Markers <br />Dear Mr. Flanders: <br />On February 8, 1949 the Division of Minerals and Geology conducted an inspection of your mine and found <br />You did not have a mine identification sign at the entrance to your mine site and the affected area <br />boundaries were not clearly marked. <br />The Division believes this is in violation of: <br />The Colorado Land Reclamation Act for the Extraction of Construction Materials, C.R.S. 3432.5-101 <br />and the regulations promulgated thereof, specifically, Rule 3.1.12 which requires the mine to be <br />properly identified and the affected areas to be clearly marked. <br />Therefore, the Division has found reason to believe a violation exists to Permit M-77-376 and the Law and <br />has scheduled this matterbefore the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the March 24th and 25th, 1999 Board meeting for consideration <br />of possible violation(s). The hearing will be held in Denver, Colorado at 1313 Sherman Street, Room 318, <br />beginning at 9:00 AM. both days. As the agenda for the meeting is firmed up, you will be notified as to what <br />day your item wit l be heard. It will be reiterated that there is reason to believe that you are in violation of the <br />provisions noted above. <br />if the Board finds a violation at this hearing, it may assess a civil penalty in the amount of $100.00 to <br />$1,000.00 for each day of violation.
