The rilling that occured on the property is
minor and will continue to be monitored.
There were several discussions about the best approach to
repairing the northwest edge of the reclaimed area where two rills had
formed due to runoff from a ditch which ends in a Swale above the area
in question. Your original suggestion of placing hay bales across the
road was unacceptable for two reasons. First, there has been evidence
of people using the perimeter road around the Bourg property. If the
road is blocked with bales, we are concerned that an alternative route,
across the reclaimed area or through Mann Draw may be taken. Also, hay
bales at the end of rills do not serve the dual purpose of the
alternative sediment control system which is not only Lo reduce
sediment but also to retain topsoil on the revegetated site.
Kay discussed the alternative of rerouting the water across the
perimeter road and off the property with you. Although this idea was
originally accepted, after some discussion we determined that rerouting
the water across the road would create the same problems as the hay
bales since the water would, more than likely, wash out the road.
After a phone conversation between you and Kay, it was determined
that stabilizing one of the rills by cutting a shallow V-ditch and
placing several rock check-dams along the length of the ditch would be
acceptable to the Division. The ditch was constructed as approved and
the second rill has been fill. It should be noted that the solution
which was finally approved was the one Walden Coal originally proposed
and is consistent with the approved alternative sediment control plan.
