The topsoil stockpile that was noted in Item 1 of your report will be seeded in the Fall of <br />2005. This stockpile was placed in this location after mining was completed in the summer <br />of 2004. <br />2. The excavation on the Upper Terrace that was within 50 feet of the utility poles also occurred <br />in the summer of 2004. I have enclosed our Structure Agreement for Mining Operation <br />between ourselves and Aquila Inc. <br />3. The upper terrace highwall that has a negative slope was not disturbed in 2004, and this <br />happened in years prior. I have located a local contractor to remedy this problem, and it <br />should be correct within the next 30 days. <br />I apologize for not getting back to you sooner on these issues. Hopefully, this should <br />remedy your concerns.
