Hays DIVISION OF RECLAMATION <br /> MINING&SAFETY <br /> FROM: Jamie McGill/Christensen <br /> RE: Objection to partial release of Green/Croissant Property Sand and Gravel Mine-File No. M-2001- <br /> 022, multiple violations and corrections never completed. <br /> I am objecting to releasing Loveland Ready-Mix Concrete, Inc from any part of mining claim M2001-022. <br /> LRM continues to have multiple violations in regards to this mining claim and have not completed <br /> corrections requested by DRMS and no actual dates of corrections posted that are available for follow <br /> up. Please see file all pictures I have submitted and the detailed third party survey provided as evidence <br /> the slope is not 3:1. It is not what LRM promised in their reclamation plan. There continues to be a <br /> large presents of noxious weeds around cells 3 and 4(Canada thistle one example, see pictures <br /> (enclosed) of it all over cell 3 where they are requesting to have it partially released). The noxious <br /> weeds are a big problem they have spread to my property as well as Steve Betz, our neighbor. Mr. Betz <br /> stated that before LRM mined the property there were no problems with noxious weeds and now it is <br /> out of control and all over his property and ours. <br /> I have enclosed copies of exhibit F-1 the reclamation plan the LRM submitted to the county for approval <br /> and it stated that they would mow and spray weeds and keep a neat appearance for weed control. They <br /> have not and have rarely done that over the years. I have provided you several pictures from my <br /> property and I am sending you pictures of cell 3 were it is out of control with Canadian thistle. It is so <br /> large and has bloomed so no way to know how badly it has spread till next year. <br /> They should not be allowed to have any of their mining claims released under any circumstances unless <br /> it is all complete. The slope is not 3:1 on the lake in cell 4 per their reclamation plan. Do you know the <br /> cost to have the lake sloped correctly? We are in the process of having our attorney request a meeting <br /> before the board at DRMS to see if they will address all of our complaints and issue a resolution once <br /> and for all. Do you know the cost to fix the erosion? They have not sprayed and taken care of noxious <br /> weeds unless there are complaints and it is out of control and spreading to neighboring property. Do <br /> you know the cost to get the noxious weeds under control? They have to reseed large sections were <br /> vegetation that is failing in cell 4? Do you know the cost and how many times they will have to reseed <br /> to meet the vegetation requirements of their reclamation plan? Stephanie Fancher English of LRM told <br /> me directly "she has all the time in the world and is in no hurry". LRM even had their lawyer tell our <br /> lawyer that they would not work with us on any requests and to do whatever we need to do. So we will <br /> this is unacceptable. That was in the last 2 weeks. This is ridiculous and mining companies should not <br /> be given mining permits if they do not follow their own reclamation plans they submit to get a permit <br /> approved. Please see enclosed pictures and documents and refer to pictures you already have. I have <br /> attached the following time line to other correspondence I am sending out. <br />
