Timeline
1. My husband and I went under contract in August 2018 and closed and purchased the property
March 2021. We started in the end of March 2021 to send pictures and documents in regards to
our concerns, here is where we are at
2. In the end of 2018-early 2019 we addressed the issue of the slope with Stephanie and Brad from
LRM they refused to address our concerns. They just said it is a 3:1 slope and they were not
fixing it. I contacted Peter Hays with DRMS and he did an inspection June 6, 2019 and agreed
with our concerns recommending a fix(see report dated 6-6-2019 correction due July 24,2019).
3. July 17, 2019 Stephanie Fancher English writes a letter to Peter Hays saying the fix is complete.
The letter is received July 23, 2019 by DRMS, see file. We provided pictures (time stamped
pictures on July 23rd 2019) showing the fix was not complete, (see file) making it impossible for
anyone to sign off on the slopes of 3:1, it was not completed. This is important because it shows
they will say anything and have people sign off on things that are not done. No intentions of
completing reclamation plan they submitted. How can they be believed?
4. Peter never inspects the mining claim until May of 2021 because LRM asks for a full release on
bond.
5. LRM used large concrete imported from who knows where and not inspected. We took pictures
of white deposits in the water where the large concrete was used and we have concerns of
water toxicity, DRMS has found it acceptable. Nothing done and nothing being done. LRM had
water samples taken but DRMS is not requesting the results. Why?
6. We continued to bring up the slope of the shore with little success. Paid thousands of dollars
using the best technology to measure the slope of the lake breaking it down into 29 zones
showing several dangerous areas. This was done by King Surveyors and is in the file. DRMS is
only requesting them fix some of the shore. Why?
7. We requested wanted to know why DRMS accepted Telesto Solutions letter dated April 8,2021
in regards to the slope based off a survey that is not accurate. It looks like they are using
information from a 2019 survey and have not visited the site. How is that acceptable? We have
pictures of LRM changing the slope in July 2019. We also asked for them to confirm all slope
measurements because their map is not readable. See letter and map no response from DRMS
8. Their reclamation plan calls for a continuous slope of 3:1. That is not what they did at all. Still
not fixed and only partial areas of the slope are being fixed. Why?
9. Noxious weeds spreading because of lack of spraying and mowing. Currently lots of weeds and
over 4 feet tall. Pictures submitted. DRMS(Peter and Jared) state it is not their job to enforce
the mowing on the reclamation plan even when we showed them Exhibit F-1 that LRM
submitted. No reponse
10. Large holes created from mining not filled and still there. No correction requested and we have
been ignored. No response or enforcement from DRMS.
11. The erosion is not 6 to 12 inches as stated in Peter and Jared's inspections reports issued in May.
Peter took picture of erosion in his report dated May 51h, 2021 but no recommended fixes page
11of 19. The erosion is over 36 inches in some areas and we have provided several pictures of
large chunks of the shore falling in the lake leaving dangerous drop offs. No response from
