O'BRIAN 303-423-7297
PRESIDENT FAX 303-423-7599
February 18, 2021
Mr. Daniel Cunninghampn
Division of Reclamation, Mining & Safety
1313 Sherman St., Suite 215
Denver, CO 80215
prvisior BAN N
Dear Mr. Cunningham;
RE: Walsenburg Sand and Gravel - Hribar Pit - M-2009-027
Amendment 01, Adequacy Response 01
On behalf of my client Walsenburg Sand and Gravel, I am responding to your
adequacy review letter dated February 2, 2021. I have included your review points that
need to be addressed in the order presented in this cover letter so the questions and
answers will be in the same document for easy future reference. The public Comment
Period ended on February 3, 2021 @ 4:00 pm.
6.4.4 EXHIBIT D - Mining Plan
1. On page 7 it states "soil covering gravel averages 0 to 8 inches deep" however on page 8 it
states "0 to 7 inches" . Please provide a statement clarifying the depth of topsoil on site.
This was a mistake it should have matched the soils information that indicates the
depth varies from 0 to 7 inches averages 5 inches. I have corrected it on that page
and will supply a copy of the revised Exhibit D that reflects the changes noted in this
review response.
2. Is there a secondary commodity that will be mined? If not please provide a statement to this
effect.
I added a note to that effect on page 6 under history. Section 5.1 is marked on
application page 1 as NA to show no incidental commodities would not be mined.
3. Does the Operator anticipate using explosives? If not please provide the necessary
information required by Rule 6.4.4(I).
No explosives will be used at the mine. It was noted that no blasting would take place
in the mine on the first line of page 12 in the original application packet.
