The relevant fee check is now included. There is one modification that does not <br /> materially affect the procedural analysis: There are two, not three, infiltration ponds planned as part of the <br /> operation of the in-situ reservoir. <br /> 41 m <br /> With that change noted, this letter is also intended to clarify and reiterate two points we discussed over the <br /> phone yesterday: <br /> 1. The activity for which the TR is requested is not a mining operation and not on affected land as <br /> currently designated in permit documents. No mining operation is permitted in this "Stage 2" area <br /> until an amendment is presented. At the time a mining operation is applied for and Stage 2 is newly <br /> affected land, the operator will be required to submit exhibits relating to all facilities in the area and <br /> the DRMS will review at that time as a mining operation, on affected land, relative to all mining and <br /> reclamation rules. <br /> 2. The TR does involve earthmoving activity, namely balanced on-site cut and fill to construct <br /> infiltration/sump ponds that will receive water rights for transfer into and out of the reservoir through <br /> ditches or other means of conveyance. None of the material excavated for this purpose will be <br /> processed, sold, removed from the site, or otherwise treated as a commodity.
