November 1, 2018 RECEIVED <br /> Colorado Division of Reclamation, Mining and Safety <br /> Attn: Ms. Amy Eschberger NOV �' <br /> 1313 Sherman St., Room 215 DIVISION OF RECLAMATION. <br /> Denver, CO 80203 MINING AND SAFETY <br /> RE: Diehl Borrow Pit, File No. M-2018-054 <br /> SEMA Construction Inc., Response to the DRMS Adequacy Comments, No. 2 <br /> Following are SEMA Construction Inc., (SEMA) responses to the Division of Reclamation, <br /> Mining and Safety's (DRMS) Diehl Permit Application, Permit Adequacy Comments. The <br /> DRMS comments are in italic font and our responses are in non-italic font. <br /> Exhibit D—Reclamation Platt (Rule 6.3.4): <br /> 1) Under section (2), the applicant proposes a reclamation bond in the amount of <br /> $67.375.00 ($2,500.00 per acre.for a total of 26.95 acres). Pursuant to Ride <br /> 4.2.4(1), the financial warranty.for a 111 Special Operation Permit shall be in the <br /> amount of not less than $2,500.00 per acre of affected land. However, the Division <br /> may require such other greater amount necessary to ensure that estimated costs of <br /> reclamation are assured. <br /> The bond estimate provided in the response did not include all costs.for completing <br /> the proposed reclamation plan. Therefore, the Division has calculated a bond <br /> estimate based on what it would cost the State of Colorado to complete reclamation <br /> using an independent contractor(see enclosed estimate). This estimate does not <br /> include costs for backftlling highwalls, as the applicant has committed to <br /> maintaining 3H:1 V slopes at the pit perimeter. The Division estimates the required <br /> financial warranty far the proposed operation to be in the amount of$88,112.00. <br /> Please review the estimate and submit any comments at your earliest convenience. If <br /> you have no comments,please state your acceptance of the Division's calculated <br /> bond amount. <br /> Please contact Barbara Coria at 303-866-3567, ext. 8148 to provide a rider to the <br /> Financial Warranty submitted with the application that covers the additional bond <br /> amount. <br /> Response: <br /> SEMA accepts the Division's calculated bond amount. Included with this response is the <br /> updated financial warranty. <br />
