The modified plan in TR -26 creates wetland habitat at Lake Irwin to mitigate for <br />unavoidable impacts to jurisdictional waters of the U.S. for the McNulty Gulch OSF expansion (TR - <br />25) as described in the attached mitigation plan submitted to the U.S. Army Corps of Engineers <br />(Corps) to support issuance of Section 404 CWA permit. <br />As a condition of the Section 404 permit Climax must demonstrate financial assurance to ensure that <br />it completes the mitigation project in accordance with the attached plan. The Corps has agreed that <br />the reclamation bond held by the DRMS can provide the necessary assurance.
