Mr. Otten and I have reviewed the preliminary <br />adequacy issues regarding DRMS permit number M1990-041 Technical Revision No. 03 (TR -03). We <br />are committed to working with you and the DRMS in completing this revision and appreciate your <br />efforts in this regard. <br />This letter provides Central City Consolidated Mining Company's ("CCMC") response to the adequacy <br />issues raised and is intended to inform the DRMS of the significant efforts made, prior and subsequent <br />to the letter of February 8, to address the specificity of the requests from the DRMS regarding the <br />zoning conformance of the building and the historic designation of the building by the State Historic <br />Preservation Office ("SHPO"). In order to continue the work necessary to address the adequacy issues <br />of the Technical Revision (TR -03), CCMC requests a one hundred and twenty (120) day extension to <br />the decision date, to allow for the work necessary to provide the DRMS with the specific answers and <br />language requested. <br />Adequacy Issue 1 Zoning Conformance <br />On December 14, 2016, when the application to the City of Blackhawk for zoning designation and <br />confirmation of zoning conformance was submitted, the CCMC's request was stated as follows: "We <br />[Mr. Otten and Matt Collins] are requesting official verification of the current Zoning and use far the <br />property as set forth by the City of Black Hawk, and verification that the current structures are in <br />compliance with that zoning" (Emphasis added). On the same day, Matt Collins contacted the SHPO <br />regarding the Goldin Gilpin mill's status as a historic structure. <br />On January 13, 2017, the City of Black Hawk, through its contractor Baseline Corp., provided the <br />response which was included in the submittal for the Technical Revision (TR -03). Matt Collins <br />subsequently replied to Julie Esterl, Planning Technician of Baseline Corp., requesting additional <br />information, verifying that the building is in compliance with the current zoning, per the language in <br />the DRMS letter of November 22, 2016. No reply was received. <br />On February 1, 2017, Matt Collins, again, contacted Julie Ested of Baseline Corp. and Cynthia Linker, <br />the Community Planning and Development Administrator of the City of Blackhawk further requesting <br />1 of 4 <br />
