Bates -Hunter TR -03 Adq Resp 1 2.2412017 <br />verification that the current structures are in compliance with current zoning. On this day, Matt Collins <br />again contacted the SHPO regarding the specificity of listing buildings within an already listed <br />National Landmark. <br />On February 10, 2017, Julie Esterl of Baseline Corp., replied with an updated letter from Vince Harris, <br />Planning Director of Baseline Corp. regarding the zoning and zoning compliance. This letter is attached <br />hereto as Exhibit H. CCMC believes this letter also fails to definitively provide the confirmation that <br />the DRMS is seeking and took further steps to provide an adequate response to the DBMS. <br />Matt Collins met with Cynthia Linker of the City of Black Hawk on February 17, 2017 to discuss the <br />need for verifying the conformance of the Golden Gilpin mill with the City's zoning and land use <br />regulations. At that time, Ms. Linker indicated that an Improvement Location Survey would need to be <br />completed and provided to the City and its agent, Baseline Corp. Mr. Collins requested documentation <br />and instruction on the further steps needed for the City of Black Hawk to verify that the Golden Gilpin <br />mill structures are, indeed, in conformance with the City's zoning and land use. No additional <br />documentation was provided to CCMC by the City of Black Hawk. <br />On February 20, Vince Harris of Baseline Corp., provided a detailed response to the DRMS and <br />CCMC's request for confirmation of zoning conformance for the Golden Gilpin mill structures. This <br />email is attached hereto as Exhibit 1. As stated in Mr. Harris' correspondence, an Improvement <br />Location Survey will need to be completed and significant review and dialogue with the City and its <br />agent, Baseline Corp. will need to occur, prior to the City issuing any definitive statement. Due to the <br />historic nature of the structures and the many changes to zoning and land use regulations, changes to <br />the highway and other modification external to the Golden Gilpin mill and the property boundaries, it <br />may be necessary to address pre-existing non -conformities (which we are told are quite common) <br />through processes internal to the City of BIack Hawk and its Board of Aldermen, prior to receiving <br />confirmation that the buildings are approved, as they are, within the City of Black Hawk, to the <br />satisfaction of the DRMS. We request extension to the decision date to allow for this work and <br />dialogue to transpire. <br />Ad_equacv Issue 2 Historic Designation <br />On December 15, 2016, the History of Colorado, Office of Archaeology and Historic Preservation <br />("SHPO") replied to Matt Collins via email, stating that one of its representatives (Section 106) would <br />be in contact with him regarding the Golden Gilpin mill. <br />On or about December 16, 2016, a representative of the SHPO contacted Matt Collins by telephone and <br />provided the information that was presented to the DBMS in the submittal for the Technical Revision <br />(TR -03). No documentation of the issue was provided however, the SHPO agent was confident that the <br />building, due to its age and location, was a contributing structure within the Central City — Black Hawk <br />National Historic Landmark and stated that this fact should be sufficient for any State of Colorado <br />agency. <br />In the submittal of the Technical Revision (TR -03) on January 27, 2017, CCMC explained that the <br />inclusion of the Golden Gilpin mill as a historic structure under Section 106 of the National Historic <br />Preservation Act of 1966 is de -facto due to its location within the Central City — Black Hawk National <br />Landmark. In order to address the adequacy issue, DRMS requires an individual determination that the <br />structure is historic and listed individually. CCMC explains that, due to its location within the Central <br />City Black Hawk National Landmark, and the covenants of that Landmark's listing, the Golden <br />2 of 4 <br />
