The material <br /> will be used at the Dill Pit, file number M2009-077. According to the provisions of Rule3.1.5 (9), "If an Operator intends <br /> to backfill inert structural fill generated outside the approved permit area, it is the Operator's responsibility to provide the <br /> Office notice of any proposed backfill activity not identified in the approved Reclamation Plan." <br /> The Notice shall include,at a minimum,the following information, Rule 3.1.5(9): <br /> a. "a narrative that describes the approximate location of the proposed activity;" <br /> Initially,the imported material may be placed either in a stockpile or placed directly on the backfilled slopes which lie <br /> along the west side of the mining operation. If placed in a temporary stockpile,the material will be located close to <br /> the point of use so it may be easily placed. Other pit slopes may be similarly treated depending on the availability of <br /> suitable material. <br /> b. "the approximate volume of the inert material to be backfilled; <br /> Up to 7,000 cubic yards may be accepted. <br /> C. "a signed affidavit certifying that the material is clean and inert,as defined in Rule 1.1.(20)." <br /> Please see the attached signed affidavit. <br /> d. "the approximate date the proposed activity will commence and end, however,such dates shall not be an <br /> enforceable condition; <br /> The importation will occur within 60 days of the effective date of this request. The importation of fill material will <br /> end once removal from the temporary stockpile is concluded. <br /> e. "an explanation of how the backfilled site will result in a post-mining configuration that is compatible with <br /> the approved post-mining land use; and <br />
