V-Tucker Livestock & Cattle LLC January 21, 2917 <br /> 43550 WCR 39 <br /> Pierce, Co 80650 <br /> RECEIVED <br /> 970-302-0681 vJAN 2 7 2017 <br /> -a DMSION OF RECLAMATION <br /> MINING AND SAFETY <br /> Colorado Division of Reclamation, mining and Safety <br /> 1313 Sherman St. Room 215 <br /> Denver, Co. 80203 <br /> 1 am writing this formal complaint concerning Weld County's Pierce North <br /> Gravel Pit, permit#1716, EPA Registry Id: 110041251267 located at the north east <br /> corner of Weld County Rd. 96 and 37. {Latitude 40 40' 22.9", (40.671 north, <br /> Longitude: 104 42' 44.99" (104.7129) west) <br /> When I apposed the construction of this pit, due to injury to my water rights on <br /> Lone Tree Creek, I was informed by Weld county officials that this is a dry pit and <br /> would not enter ground water. I was also told the pit would not be constructed in <br /> the Lone Tree creek channel. In the spring/summer of 2016 Lone Tree creek had <br /> a large amount of water flow. Weld County's Pierce north Gravel pit captured ALL <br /> the water flow in the creek. I did not receive any water during the 2016 season, <br /> which I was entitled to. <br /> 1. The pit is currently in operation as a wet pit, "not a dry pit". Water is being <br /> mined with sand /gravel from Lone Tree Creek and removed to other <br /> locations across the county. The water mined is thus delivered to off sight <br /> locations without replacement water to Lone Tree Creek. Weld County has <br /> no Augmentation plan to address this. <br /> 2. Evaporation is occurring 365 days per year from exposed surface water in <br /> this pit, as well as Weld County's abandoned Pierce north gravel pit, <br /> northwest corner of County Rd 94 & 37. Weld County has no <br /> Augmentation to address this. <br />
