Mr. Brock Bowles <br />Environmental Protection Specialist <br />Colorado Division of Reclamation Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: Colorado Coal Mine Permit #C-1981-008, SL -19 & TR -75 <br />Dear Brock, <br />In response to your letters dated July 22, 2016, where you are requesting additional information to our Objection <br />dated July 15, 2016 and received by DRMS on July 17, 2016, please find our concerns followed in parentheses the <br />"Rule" within the Regulations of the Colorado Mined Land and Reclamation Board for coal Mining (Effective <br />August 30, 1980) that governs our concern. <br />We will discuss our concerns with you sometime during the July 16, 2016 meeting and field inspection. <br />Of concerns to landowner pertaining to TR -75: <br />1. Landowner does NOT want a haul/service road left on the north end of the property (4.03) & (4.16). <br />2. All property has to be permitted as irrigated pastureland, as it was prior to mining (4.16). <br />3. All property has to be planted and growing irrigated pastureland, as it was prior to mining (4.15) & (4.16). <br />4. All land has to have a means to be irrigated by since flood/furrow irrigation is no longer possible (4.05) . <br />5. New Horizon Mine has to irrigate, fertilize and mitigate noxious weeds on the old haul road during the <br />required bond period (4.15) & (4.16). <br />Of concerns to landowner pertaining to Phase III Bond Release: <br />1. Meander Ditch (Ditch No. 209, Case No. 4641, Priority No.'s 267 & 314) has been removed and has to be <br />reinstalled by the mine (4.05) & (4.16). <br />2. Noxious weeds need to be eradicated by the mine (4.15). <br />3. Top Soil stockpile needs to be addressed (4.06). <br />4. Stock pond in NE corner of Lot 3 needs reconstructed (4.05) & (4.16). <br />5. Cistern was removed to make Pond 007, a replacement needs to be installed (4.05) & (4.16). <br />6. Roadway on west side of Pond 007 to the home site needs to be reinstalled (4.15) & (54.16). <br />7. Cattle guards and gates on 5`h road need to be reinstalled (4.16) . <br />Sincerel , <br />/mmy R.
