Box 587 <br />Nucla, CO 81424 <br />Re: New Horizon Mine (Permit No. C-1981-008) <br />Technical Revision 75 (TR -75) <br />Objection Letter <br />Dear Mr. Guire: <br />Thank you for your letter dated July 15, 2016 regarding TR -75 at the New Horizon Mine in Nucla, Colorado, <br />which was received by the Division by certified mail on July 17, 2016. In your letter, you state that you are <br />objecting to TR -75 in its entirety. <br />Western Fuels -Colorado (WFC) submitted an application for TR -75 to the Division on July 11, 2016. The <br />application was found to be `incomplete' on July 21, 2016 at which time WFC was given the chance to make the <br />application complete. WFC has not submitted the proper documents as of this letter to make the application <br />complete. <br />Since the application is considered incomplete, a public notice will not be advertised in the local newspaper <br />initiating the 10 -day public comment period at this time. When WFC submits the proper documents and the <br />application is considered complete, a newspaper advertisement will then be published which initiates the 10 -day <br />public comment period. The Division realizes that you were unaware of this administrative delay and submitted <br />your objection with the intent of filing it within the comment period. Therefore, the Division will file your <br />objection to TR -75 as received. <br />Your letter stated that you object to TR -75 in its entirety, but it did not include an explanation of your objections. <br />We would appreciate receiving this explanation in writing.
