According to our records, the <br />following problem was to be resolved on or before January 25, 2016. Listed below are descriptions <br />and corrective actions for the problem(s). Please resolve the corrective actions and provide <br />evidence of such resolution on or before July 15, 2016. <br /> <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to the <br />Division by the date provided above, the listed problems could be escalated to the level of possible <br />violations and would then be referred to the Mined Land Reclamation Board for further action. <br /> <br />On October 26, 2015 the Division of Reclamation, Mining and Safety (Division) received a request <br />for a Technical Revision (TR-01) addressing the following: <br /> <br /> Acreage Revision/Adjustment. <br /> <br />Pursuant to Rule 1.9.1, the submittal was called complete for the purpose of filing on October 26, 2015 <br />when the fee was received. The TR fee was received in response to the attached inspection report <br />mailed on September 15, 2015 requesting a response to the Division’s assessment that the area <br />disturbed by mining associated with this permit was 37.7 acres, which is 2.7 acres more than the <br />maximum allowed by the approved permit of 35 acres. The Division proposed three separate options <br />(as shown in blue text below) that could be expected to address the additional acreage disturbance by <br />submitting one of the following: <br /> <br />1. A Technical Revision, along with the required $216 fee to increase the maximum allowed <br />disturbed area; This option should be used if you agree with the Division’s assessment that <br />the mine-related disturbed area is greater than the currently allowed 35 acres and the <br />Technical Revision request should include a revised number of acres proposed to be
