A map showing this area might be very helpful in describing the proposed area <br />of maximum disturbance. <br />2. Documentation demonstrating the actual disturbed area is no more than the required 35 <br />acres; This option should be used if you disagree with the Division’s assessment that the <br />mine-related disturbed area is greater than the currently allowed 35 acres. If this is the case, <br />you will need to submit documentation, such as a survey map that shows the limits of the <br />current disturbance. Please be aware there is no fee for this option and if you choose this <br />option, the Division will refund your $216 fee for the Technical Revision. or <br />3. Request an acreage reduction of at least 2.7 acres for an area that is reclaimed in <br />accordance with the approved reclamation plan and will not be used for any mining <br />activity in the future. This option should be used if you agree with the Division’s <br />assessment that the mine-related disturbed area is greater than the currently allowed 35 <br />acres, but you believe at least 2.7 acres of mine-related disturbance has been reclaimed in <br />accordance with the approved permit and you plan no further disturbance in those areas and <br />you wish to remove those areas from your permit area. A map showing the proposed area <br />you intend to release from the permit area is required, and a follow-up inspection will be <br />necessary to determine if this area has been reclaimed in accordance with the approved <br />reclamation plan. Please be aware there is no fee for this option and if you choose this <br />option, the Division will refund your $216 fee for the Technical Revision. <br /> <br />It is my understanding that you wish to pursue Option 1 above and increase the maximum affected <br />area.
