Box 1484 <br /> Idaho Springs, CO 80452 <br /> May 24, 2016 <br /> Mr. Michael Cunningham <br /> Environmental Protection Specialist <br /> RE: Phoenix Mine; DRMS File No. M-1982-075; Modification to Reclamation Plan. <br /> Dear Mr. Cunningham, <br /> This is in response to an Adequacy Review No.1 letter sent by the State of Colorado Division of <br /> reclamation and Mining Safety on April 12th, 2016. The letter discussed the Adequacy of a requested <br /> Technical Revision to the reclamation plan DRMS File No. M-1982-075, dated March 23, 2016. <br /> The Adequacy Review letter had five comments that needed addressing. The following is a list of <br /> each of the comments as stated in the March 23 letter with the requested information for each <br /> comment. These are as follows: <br /> 1. "The Operator has identified how the various surface facilities will be reclaimed. On February <br /> 22, 2016, the Division issued a financial warranty increase to account for the demolition of structures <br /> and the removal of refuse. The actions the Operator has outlined will result in a decrease of the <br /> financial liability associated with reclaiming the site. The Division will withdraw the surety increase to <br /> allow the Operator time to complete the proposed reclamation activities if the Operator provides <br /> the Division with a reasonable timeline for completing such actions. In absence of a timeline to <br /> complete the proposed activities, the increased financial warranty will be due on April 22, 2016. " <br /> Mosch Exploration & Mining, LLC and Phoenix Gold Mine Tours request a final reclamation date of <br /> June 1st, 2017. Portions of the reclamation work will be conducted during the summer of 2016 but <br /> some of the work should be completed during the"off season"for the tour business for safety <br /> reasons. <br /> 2. "The Operator has proposed leaving the fuel tanks in place. The fuel tanks are not historic <br /> structures, nor are they unique to underground mining operations. The Division requests the <br /> Operator commit to removing the he fuels tanks.Alternately, the fuel tanks may remain if they <br /> are decommissioned by drilling or cutting holes into the bottom of the tanks. Photographs may <br /> be used to demonstrate the fuel tanks have been decommissioned. Please respond." <br />
