Mosch Exploration & Mining, LLC and Phoenix Gold Mine Tours request that both tanks remain on <br /> site for facility operational purposes. The smaller tank will remain as a diesel fuel storage tank with <br /> adequate spill containment. The tour mine operation is not currently connected to line electrical <br /> power and relies on solar power for lighting but needs generated power for facility maintenance <br /> activities. In the future, the larger tank will not be used for fuel storage but will remain and be used to <br /> contain firefighting water in the summer time. The tank will be painted blue and have appropriate <br /> signage, fittings and pump for fighting purposes. Converting the larger tank to a fire fighting tank has <br /> already been partially completed.Water for firefighting is bought from the nearby town of Idaho <br /> Springs. <br /> 3. "The Operator has requested to leave the historic mine building in place so that it may be <br /> used for the mine tours. Please provide documentation from the county which demonstrates <br /> the structure is in conformance with local zoning requirements." <br /> The zoning department of clear Creek County was contacted to provide documentation concerning <br /> the conformance of the historic mine buildings being used for mine tours. The following was provided <br /> by Brad Boland, Clear Creek Planner 1 —Zoning Specialist on May 191h. The original e-mail will be <br /> forward to the division. <br /> "Brad Boland,bboland@co.clear-creek.co.us. <br /> May 19 at 8:58 AM <br /> David, <br /> We have determined that the Phoenix Gold Mine Touring Operation is a legally non-conforming <br /> use. This includes all existing buildings and they may remain as part of the tour <br /> operation. If the use is to expand a Special Use Permit will need to be approved. I have <br /> attached the Special Use Permit process guide for your reference in the future. "The Division recommends that the Operator carefully document the removal of <br /> scrap metal and refuse from the site. Please respond. <br /> Mosch Exploration & Mining, LLC and Phoenix Gold Mine will provide the State of Colorado Division <br /> of reclamation and Mining Safety a set of photographs taken from various fixed locations at specific <br /> directions to document the scrap metal removal.
