Your original questions or requirements are listed, with <br /> responses in bold. <br /> 5. Provide the size of each of the proposed tracts in acres. Please note that if the sizes of these tracts <br /> need to be revised in the future, the Operator shall submit a Technical Revision to revise the Mining <br /> Plan, reflecting this change. <br /> The sizes are noted on the attached Mining Map Exhibit. If the tract sizes are revised as a new <br /> area is opened, a Technical Revision will be filed with the Division to reflect the change. <br /> 11. Please acknowledge the following clarification. If this conversion application is approved, CDOT <br /> (the operator of the adjacent M-1979-160 permit) can submit an acreage reduction for the area of their <br /> permit that will be overlapped by your conversion application(Tract 6). This request would be <br /> approved by the Division because this area will now be covered under the M-1986-074 reclamation <br /> permit. If you decide to not disturb Tract 6 as proposed, you will still be responsible for maintaining <br /> this area by having the slope free of excessive erosion and noxious weeds, and is adequately vegetated <br /> with the desired seed mixture at the time of any future release requests. Please note that you will not be <br /> required to achieve your maximum allowed slope (3H:IV) in this area if left undisturbed. <br /> We acknowledge the Division's clarification regarding the area overlapped (Tract 6) in the M- <br /> 1979-160 CDOT pit). <br /> 12-13. Responses regarding seeding rates and fertilization rates are based off a previous reclamation <br /> plan for the property. This previous plan may be outdated or determined for a different land-use; the <br /> Division requests the Operator to obtain and submit a new NRCS recommendation for the site regarding <br /> the proposed plan and post-mining land-use. <br /> We requested NRCS to prepare a new seeding plan. That recommendation is attached. <br /> 17. The new Exhibit F Reclamation Plan Map depicts the proposed post-mining within the permit <br /> boundary. The Division believes that the northwest portions of the depicted post-mining topography do <br /> not connect to existing topography properly. Please update this map by adjusting any post-mining <br /> topography AND show the current topography outside of the permit boundary. <br />
