Submit correspondence from Water Quality Control Division(WQCD) of the Colorado Department <br /> of Public Health and Environment demonstrating that the proposed plan will not require a permit OR <br /> commit to obtaining a Stormwater Discharge Permit. <br /> Correspondence has been forwarded to the WQCD regarding need for a permit on this mining <br /> activity. No action will be taken until a response is received. That response will be provided to <br /> the Division. <br /> 24. Please note that any changes or additions to the application on file in our office must also be <br /> reflected in the public review copy, which was placed with the Logan County Clerk and Recorder by the <br /> Operator. Please submit proof that the public review copy has been updated with the response to this <br /> adequacy letter as well as the previous response for the first adequacy letter. <br /> The previous response was sent to the Logan County Clerk. No proof of mailing was sought. <br /> Enclosed is a statement by the Clerk's Office that the information was received. A proof of <br /> mailing for this response will be forwarded as soon as delivery is complete. <br /> 25. Based on the response regarding the structures on property owned by Roman and Tiffany Contet, <br /> Darrell and Shirley Smith, Gregory and Jill Yocumb, and Wayne and Debra Klee, the Division will <br /> attach a stipulation to the approval of the conversion application. The Stipulation is as follows: The <br /> Operator agrees to not disturb lands within 200 feet of any structure until structure agreements are <br /> received and accepted by the Division. <br /> Please submit an updated Mine Plan Map depicting a buffer line at least 200 feet from these structures. <br /> This buffer line will also need to be clearly marked on the ground. <br /> The enclosed Mining Map Exhibit depicts the 200-foot buffer line.
