Schure <br />12826 County Road 37 <br />Sterling, CO 80751 <br />Re: Dollerschell Pit, Permit No. M-1986-074, Additional Adequacy Letter CN -01 <br />Dear Mr. Schure, <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of your response (received <br />September 4, 2015) to the Division's April 28, 2015 adequacy letter for the Conversion Application (CN -01) of <br />the Dollerschell Pit, File No. M-1986-074, and submits the following comments. Please be aware that the Board <br />Order of Violation No. MV -2014-040 imposed the corrective action that this conversion application must be <br />approved within 180 days of the effective date of the Order (mailed on December 5, 2014) as amended during the <br />June and September Board hearings. Following the Board Order, the Division is required to make an <br />approval or denial decision no later than October 23, 2015; therefore, a response to the following adequacy <br />review concerns should be submitted to the Division as soon as possible. In order to allow the Division <br />adequate time to review your responses to the adequacy issues, please submit your adequacy responses to the <br />Division no later than one week prior to the decision date (on or before October 19, 2015). <br />The review consisted of comparing the adequacy response content with specific requirements of Rules 1, 3, 6. 1, <br />6.2, and 6.4 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials. Further inadequacies are identified under the respective item number. <br />Responses for items 1-4 are adequate as submitted. <br />5. Provide the size of each of the proposed tracts in acres. Please note that if the sizes of these tracts need to <br />be revised in the future, the Operator will shall submit a Technical Revision to revise the Mining Plan, <br />reflecting this change. <br />Responses for items 6-10 are adequate as submitted. <br />11. Please acknowledge the following clarification. If this conversion application is approved, CDOT (the <br />operator of the adjacent M-1979-160 permit) can submit an acreage reduction for the area of their permit <br />that will be overlapped by your conversion application (Tract 6). This request would be approved by the <br />Division because this area will now be covered under the M-1986-074 reclamation permit. If you decide <br />to not disturb Track 6 as proposed, you will still be responsible for maintaining this area by having the <br />slope free of excessive erosion and noxious weeds, and is adequately vegetated with the desired seed <br />mixture at the time of any future release requests. Please note that you will not be required to achieve <br />your maximum allowed slope (3H:1 V) in this area if left undisturbed. <br />12.43. Responses regarding the seeding rates and fertilization rates are based off of a previous reclamation <br />plan for the property.
