The new Exhibit F Reclamation Plan Map depicts the proposed post -mining topography within the permit <br />boundary. The Division believes that the northwest portions of the depicted post -mining topography does <br />not connect to existing topography properly. Please update this map by adjusting any post -mining <br />topography AND show the current topography outside of the permit boundary. <br />Responses for items 18-22 are adequate as submitted. <br />23. Submit correspondence from Water Quality Control Division (WQCD) of the Colorado Department of <br />Public Health and Environment demonstrating that the proposed plan will not require a permit OR <br />commit to obtaining a Stormwater Discharge Permit. <br />24. Please note that any changes or additions to the application on file in our office must also be reflected in <br />the public review copy, which was placed with the Logan County Clerk and Recorder by the Operator. <br />Please submitrn oof that the public review copy has been updated with the response to this adequacy letter <br />as well as the previous response for the first adequacy letter. <br />25. Based on the response regarding the structures on property owned by Roman and Tiffany Contet, Darrell <br />and Shirley Smith, Gregory and Jill Yocumb, and Wayne and Debra Klee, the Division will attach a <br />stipulation to the approval of the conversion application. The Stipulation is as follows: The Operator agrees <br />to not disturb lands within 200 feet of any structure until structure agreements are received and accepted by <br />the Division. <br />Please submit an updated Mine Plan Map depicting a buffer line at least 200 feet from these structures. <br />This buffer line will also need to be clearly marked on the ground. <br />This concludes the Division's follow-up adequacy review of this application and adequacy responses. This letter <br />shall not be interpreted to mean that there are no other technical deficiencies in your application. Other issues may <br />arise as additional information is supplied.
