We do not really see a <br />protest of the application in this letter. We expect the Division to notify the County of its <br />decision and once that is done, we will work with the County Planner to address the <br />requirements that are outlined and attached to the letter. We also spoke with Mark Dowaliby <br />and he was appreciate that Todd Sullivan was the only operator in the valet so far that has <br />made a commitment to the hours of operation of the pit. <br />2. Adam Guthrie letter received by the Division on August 12. Mr. Guthrie expresses <br />legitimate concerns about the mishaps that have occurred in the area. It should be pointed <br />out that this proposed operation is only a 2 man operation that is tremendously smaller than <br />the other operations in the valley. Also, the permit process for this permit has been much <br />stricter than all of the other permits, partly due to the concerns that some in the community <br />have raised. Mr. Guthrie should be happy to know that the operation has new commitments <br />on hours of operation, which are listed at the end of this letter. The equipment is not in place <br />for any large scale gravel sale operation. Machinery noise is a legitimate concern and since <br />the vast majority of the operation will be below grade of Platte Drive and Highway 9, it is <br />not expected that noise will be a concern. The concern about property values is not in the <br />jurisdiction of the DRMS but nevertheless, the low volume of this operation in addition to <br />the fact that the majority of the operation is not visible from public areas, we do not feel that <br />property values will be adversely affected. The total disturbed area of this operation at any <br />one time is less than 5 acres. <br />
