Racine Circle <br />Centennial, CO 80111 <br />Re: Clapper Sand Pit, Permit No. M- 2015 -010, 111 Construction Materials Special Operation <br />Reclamation Permit Application, Adequacy Review <br />Dear Mr. Bell, <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the Castle Rock <br />Construction Company of Colorado, LLC 111 Construction Materials Reclamation Permit Application for the <br />proposed Clapper Sand Pit, File No. M- 2015 -010, and submits the following comments. The Division is <br />required to make an approval or denial decision no later than April 3, 2015; therefore, a response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. In order to <br />allow adequate time to review your responses to any adequacy issues, please submit your adequacy responses to <br />the Division no later than April 2, 2015. <br />The review consisted of comparing the application content with specific requirements of Rules 1, 3, 6.1, 6.2, and <br />6.3 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br />Construction Materials. Any inadequacies are identified under the respective exhibit. <br />Exhibit B — Site Description (Rule 6.3.2): <br />1. Please change "South Platte River" to the "South Fork Republican River" in the following statement <br />(application paragraph numbered 8 in Exhibit B): after reclamation the pit will ultimately drain toward <br />Spring Creek (as the property does currently) and ultimately to the South Platte River to the north. <br />Exhibit D — Reclamation Plan (Rule 6.3.4): <br />2. In the application revisions received March 23, 2015, the Applicant proposes to construct a small, <br />permanent berm around the west and north sides of the pit to keep stormwater from flowing down the <br />reclaimed slopes and to help prevent high flows from Spring Creek from entering the pit. Please commit <br />to keeping the slopes of this berm no steeper than 31-1:1V. The Berm Detail on the Reclamation Plan Map <br />will need to be updated to reflect this change. Additionally, please verify with Kit Carson County that no <br />permits or approvals are needed to construct this berm in the floodplain of Spring Creek. <br />Exhibit I — Proof of feline with County Clerk (Rule 6.3.9): <br />3. Please note that any changes or additions to the application on file in our office must also be reflected in <br />the public review copy, which was placed with the Kit Carson County Clerk and Recorder by the <br />Applicant.
