Ralph Bell <br />March 30, 2015 <br />Page 2 of 2 <br />Exhibit L — Permanent Man -made Structures (Rule 6.3.12): <br />4. In the application revisions received March 23, 2015, the Applicant provided a structure agreement with <br />the Kit Carson County for County Road U. In accordance with Rule 6.3.12(a), please have this agreement <br />notarized. <br />5. During the pre - operational inspection of the site on March 26, 2015, the Division observed a well casing <br />(approximately 24" dia.) in the southern portion of the site and another within 200 feet of the western <br />boundary (with coordinates 39 °16'49.76 "N 102 °45'30.56 "W and 39 °16'51.23 "N 102 °45'41.59 "W). <br />These were not indicated on the Mine Plan Map or list of structures and will need to be updated. Please <br />also provide the Division with the plan for the well casing and mining operations for the one located <br />within the permit boundary. <br />6. While reviewing the site on Google Earth, the Division has observed a linear surface disturbance feature <br />that runs north -south through the middle of the site. This feature appears to start from a group of <br />structures near County Road U and ends at a livestock water tank Y4 of a mile south of the site. This <br />feature also passes through/near the well casing discussed above. The Division was unable to verify what <br />this disturbance was during the pre - operational inspection. Please provide information on this feature as it <br />may be some sort of utility line and comply with Rule 6.3.12 if necessary. A Google Earth image dated <br />7/17/2013 which shows the feature in question, has been attached for the Applicant reference. <br />This concludes the Division's adequacy review of this application. This letter shall not be interpreted to mean that <br />there are no other technical deficiencies in your application. Other issues may arise as additional information is <br />supplied. Please be advised the Clapper Sand Pit permit application may be deemed inadequate, and the <br />application may be denied on April 3, 2015, unless the above mentioned adequacy review items are addressed to <br />the satisfaction of the Division. If more time is needed to complete the reply, the Division can grant an <br />extension to the decision date. This will be done upon receipt of a written waiver of the Applicant's right to <br />a decision by April 3, 2015 and the request for additional time.
