Pursuant to an agreement signed by the <br /> Division and Wildcat on February 7, 2014 and approved by the Board on February 19, 2014 <br /> Wildcat acknowledged that it is subject to a cease and desist order and will not conduct any <br /> mining,milling,or reclamation related operations or activities other than those approved by the <br /> Division in writing necessary to bring the permit into compliance and to prevent damage to <br /> offsite areas and to protect human health and safety. <br /> This letter is to remind Wildcat that its permit is in a suspended status and the only <br /> allowable permit activities,including requests to revise the permit, are those necessary to bring <br /> the mining operation into compliance. Wildcat has submitted and received either a full or a <br /> partial approval from the Division for: TR-01 addressing the May Day 1 portal, TR-02 <br /> addressing the access road, TR-04 addressing the May Day 2 portal, and TR-05 addressing the <br /> Chief portal and associated drainage. Wildcat must implement these approved plans to satisfy <br /> the numerous outstanding corrective actions as a condition precedent to seeking permit <br /> reinstatement. <br /> Before the Division will accept for review any additional revisions or modifications to <br /> the suspended permit, including requests for surety reduction, Wildcat must implement the <br /> already approved plans to satisfy the outstanding corrective actions that currently exist at the site <br /> and obtain permit reinstatement. As ordered by the Board on February 19, 2013 "All remaining <br /> corrective actions set forth in the December 2011 Order shall be completed prior to the end of <br /> the 2015 construction season, or earlier if possible.
