11/17/2014 State.co.us Executive Branch Mail - Fwd: FW: MWNW and an illegal well that has to be removed
STATE, OF Hernandez - DNR Alysha <aysha- hernandez @state- co -us>
COLORADO
Zuber - DNR, Rob <rob.zuber @state.co.us> Mon, Nov 17, 2014 at 8:47 AM
To: Alysha Hernandez - DNR <alysha.hernandez @ state.co.us>, Mary Rodriguez - DNR
<mary.rodriguez@state.co.us>
Alysha /Mary —
Please file this Southfield email under General Correspondence and name it "Email from Linda Saunders."
Thanks,
9
Hi Dave --
Last Thursday, I spoke on the phone with Ground Water Commissioner Dale Baker from DWR's office in Pueblo
regarding his 10/7/13 meeting with Linda Saunders at the Southfield Mine on Vento property. Here's what he had
to say:
He will be writing neither an inspection report nor a memo to anyone regarding his 10/7/13 visit to the
Southfield mine.
He told me that DWR is not planning to issue or take enforcement action against EFCI regarding the two
wells that are the subject of Linda Saunders' e-mail below. He said that DWR deals with landowners, not
third parties, when it comes to unpermitted wells. He told me that it's Linda Saunders' responsibility, not
EFCI's, to comply with DWR's well permitting requirements regarding the two wells mentioned by Linda
Saunders in her e-mail below, indicating that DWR is of the opinion that it's Linda Saunders, not EFCI,
who is presently out of compliance with DWR's well permitting requirements. He said that if landowners
have issues regarding wells drilled by third parties on their (the landowners') property, those issues need
to be resolved between the landowners and the third parties, not between DWR and the third parties.
He told me that when he asked Linda Saunders during his site visit what it was that she wanted, he told
me that she had told him that she wants a domestic well. He told me that she could probably obtain a
domestic well permit for the MWNW well if she were to apply for it.
Regarding the 2nd well in Linda Saunders' e-mail, it appears to be a defunct mine dewatering well. It lies
east and a bit north of the MWNW well. From what Rob and I can tell, this second well is also on Vento
property. It appears to be a well identified by Southfield on their hydrology map as mine dewatering well
Zenith #2. Rob at his last inspection of Southfield took pictures of what he thought might be this 2nd
well, sent them to Linda Saunders, and asked her to verify if the well he photographed was this 2nd well.
Ms. Saunders said it was. This 2nd well is not required by us to be monitored by EFCI.
https: / /mail.googl e.com /m ai I /u/0 / ?ui =2 &i k= e29129fcb5 &view =pt &search= i nbox &th= 149be700b823e9ff &si m l= 149be700b823e9ff 1/3
