Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. <br />The Division received comments from the Army Corps of Engineers. The letter has been <br />attached for your review; please address the comments noted in the letter and make any <br />necessary changes to the application. <br />2. As required by Rule 1.6.2(1)(g), please submit proof of publication and proof of all required <br />notices. Proof of Notice may be by submitting return receipts of a Certified mailing or proof <br />of personal service. <br />6.3.4 Exhibit C — Mining Plan <br />The Applicant has stated the water which will be used to wash the aggregates will be <br />collected from Baldwin Creek. Pursuant to Rule 3.1.6(1)(a) operations must be in compliance <br />with applicable Colorado water laws and regulations governing injury to existing water <br />rights. In order to divert water from Baldwin Creek, the Applicant must demonstrate that they <br />have a legal right to the water or the Applicant may specify an alternate legal source of water. <br />4. The Applicant has stated that the aggregates will be washed at the Mill site. Any area used <br />for processing, regardless of size, must be included in the affected area.
