S(avt - <br />- -- - <br />6- 1991 -000 <br />PROS <br />LEGAL NOTICES <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to'Approve Permit Revision Application No. 8, <br />submitted by Western Fuels- Colorado, LLC for a coal mining permit at the New Horizon Mine (Permit No. C- 1981 -008). <br />The revision addresses prime farmland reclamation practices, including topsoil redistribution and revegetation plans; <br />replacement of the irrigated cropland technical standard with a reference area; and determination of prime farmland areas. <br />The New Horizon Mine is a surface operation located in Montrose County, approximately 1.7 miles Northwest of Nucla, <br />Colorado. Coal interest is Private, and the surface to be affected is Private land. The permit area encompasses approxi- <br />mately 926.06 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado <br />Surface Coal Mining Reclamation Act, Section 3433101, et seq., CR.S., and the regulations promulgated thereunder. <br />Copies of the proposed decision, including any stipulations, are on file for public inspection at the Colorado Division of <br />Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at <br />the Montrose County Courthouse, 300 Main Street; Nucla, CO 81424. Persons with an interest that may be adversely <br />affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and <br />must state with reasonable specificity the reasons for the request and the objections to the proposed decision. <br />Published in the San Miguel Basin Forum on February 13 and February 20, 2014 <br />SMPA Board of Directors Proposes Bylaw Changes <br />The Board of Directors of San Miguel Power Association Inc. will be hearing public comment on proposed Bylaw changes <br />during the Member Comment portion of their Regular Meeting to be held at 9:30AM on February 17, 2014 at the Ridgway <br />office, 720 N. Railroad St., Ridgway, Colorado and at their Regular Meeting to be held at 9:30AM on March 25, 2014, at <br />the Nucla office, 170 W. 10th Ave., Nucla, Colorado. The Board will be conducting a final vote on the proposed changes <br />at their Regular Meeting to be held at 9:30AM on March 25, 2014, at the Nucla office, 170 W. 10th Ave., Nucla, Colorado. <br />The proposed Bylaw amendments clarify (i) how to become a member, (ii) the differences between a member and a patron, <br />(iii) how SMPA will handle members with multiple accounts, (iv) how notices are posted at SMPA's offices and the web - <br />site, (v) qualifications for directors and director candidates, (vi) director attendance at meetings, (vii) the duties of certain <br />officers of SMPA, and (viii) what happens with unclaimed capital credits. <br />r • , _._.__. _ca non 4IA cS.tO nr the Nnrli office . 970- <br />E <br />
