OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM /POSSIBLE VIOLATION: Problem: 2013 Annual Report Discrepancy: Item #7 indicates only —80 acres <br />of affected area. Item #12 indicates 120 acres have been backfilled. Backfilled, topsoiled, reclaimed, etc. areas <br />are considered affected area until the Division approves an Acreage Release request. <br />CORRECTIVE ACTIONS: Provide the Division with a revised 2013 Annual Report clarifying the affected area to <br />include: mining, plus incomplete and /or unreleased reclamation by the corrective action due date. <br />CORRECTIVE ACTION DUE DATE: 10/15/13 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM /POSSIBLE VIOLATION: Problem: The current mine plan needs to be updated and clarified pursuant to <br />C.R.S. 34- 32.5 -112 (1)(c)(VI),(VII). The operator must provide: sufficient information to describe or identify how <br />the operator intends to conduct the operation, and the size of the area to be worked at any one time. <br />CORRECTIVE ACTIONS: The operator shall submit: a) an approvable Acreage Release Request, or b) a Technical <br />Revision, with the required $216 revision fee, to update and clarify the current approved mine plan affected <br />area (currently approved for 100 acres) to reflect existing and proposed activities by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 11/22/13 <br />Page 1 of 6 <br />
