If a <br />Possible Violation is indicated, you will be notified underPossible Violation is indicated, will be notified under separate cover as to when the Mined Land <br />as to when the Mined Land <br />Reclamation Board will Reclamation Board will consider possible enforcement action enforcement action. <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM /POSSIBLE VIOLATION: Problem: The Division's files indicate Henderson did not submit an annual <br />report and fee for the NOI in 2012 for the 2011 -12 activity. <br />CORRECTIVE ACTIONS: Henderson must submit the annual report and provide the required annual fee by the <br />corrective action date. <br />CORRECTIVE ACTION DUE DATE: 11/17/13 <br />OBSERVATIONS <br />The Red Mountain Exploration Drilling project was inspected by Peter Hays with the Division of Reclamation, <br />Mining and Safety (Division) as part of the Division's monitoring inspection program. Mr. Bryce Romig, Mr. <br />Miguel Hamarat and Ms. Nyssa Loepke with Climax Molybdenum — Henderson Operations (Henderson) were <br />present during the inspection. <br />The original Red Mountain NOI included the construction of five drill pads with two holes planned per pad and <br />the required access roads. The NOI was issued by the Division on August 1, 2011. The NOI was modified in <br />2012 to include the construction of three additional drill pads (Sites #6 -8) and road construction on Harrison <br />Mountain. The modification (MD -01) was issued by the Division on June 20, 2012. All exploration activity was <br />expected to be completed by October 31, 2013. <br />Page 1 of 4 <br />
