Division Initial Comment: Per Rules 2.04.11(4) and 2.05.6(2), please update T &E <br />species and discuss potential impacts to current State and Federal Threatened and <br />Endangered plant and animal species lists. The Federal and State listed species of <br />concern may have changed since the last revision. To find the most up to date lists, the <br />following websites may be helpful: http: / /www.fws.gov /mountain- <br />prairie/ endspp /CountyLists /Colorado.pdf and <br />http:/ /wildlife. state. co.us/WildlifeSpecies /SpeciesOf Concern /ThreatenedEndangeredList/ <br />Pages/Li stOfThreatenedAndEndan eredSpecies.aspx <br />TC Response: The most recent Colorado list was reviewed, and contacts with Colorado <br />Parks and Wildlife confirmed that no TES species, with known range of occurrence <br />overlapping the Mine Permit Area, have been added to the List since the last permit <br />update of the relevant section (2010). <br />Division Response: In order to address the initial adequacy comment, the Division <br />requests a review and concurrence letter from either the USFWS or the CPW addressing <br />any updates associated with Federal or State TES. The Division understands that TC is <br />currently in discussions with CPW personnel to receive concurrence with TC's response <br />to the Divisions initial comment. Please provide the Division with a copy of the <br />concurrence letter if received by the CPW. <br />9. Division Initial Comment: Approved Maps 23, 2313, and 23C show the 5 -year mining <br />plan for the Foidel Creek Mine. An updated mine plan has not been approved by the <br />Division since the previous 5 -year plan. Please revise the proposed text or the proposed <br />above mentioned maps to reflect the approved mine plan if needed. <br />TC Response: The referenced permit text and maps were recently updated to reflect <br />current plans, and submitted to the CDRMS as part of the PR12 -09 and TR13 -82 <br />submittals. <br />Division Response: This response is adequate. <br />10. Division Initial Comment: Approved page 2.05 -3 states that Map 23C identifies the <br />proposed subsidence monitoring locations. These locations were not identified on Map <br />23C. Please revise the proposed page to identify the correct locations of subsidence <br />monitoring, or revise Map 23C to include subsidence monitoring locations. <br />TC Response: TC conducted extensive subsidence monitoring during the initial longwall <br />mining operations in the EMD and NMD to evaluate and verify the accuracy of the pre - <br />mining subsidence evaluations, and to assess subsidence effects on area streams and <br />surface structures, including roads, the rail spur, and powerlines. Subsidence monitoring <br />results correlated very closely with the subsidence evaluations and projections, and <br />verified that mining - related subsidence was not adversely impacting drainages, <br />structures, or renewable resource lands. <br />
