energy fuels coal, inc. i southfield mine - post office box 459 - florence, colorado 81226 - (719) 784 -6395 July 29, 2013 Ms. Janet Binns— Reclamation Specialist Colorado Division of Reclamation Mining & Safety 1313 Sherman St —Room 215 Denver, CO 80203 RE: ADDENDUM - Midterm Review (MT6) Response —Minor Revision No.60 (MR -60) Energy Fuels Coal, Inc.— Permit No. C -81- 014 — Southfield Mine Dear Janet Binns: This transmittal is addendum to Minor Revision No.60 (MR -60) dated April 3, 2013 that was previously submitted in response to the Division's Midterm Review (MT6) dated February 19, 2013 concerning Energy Fuels Coal, Inc' (EFCI) Southfield mine. This Addendum addresses Identified Issues that were not addressed in Section V in the MR -60 April 3, 2013 submittal to the Division. As before, responses are in an answer format following the same numerical sequence as presented in the Division's Midterm Review (MT -6). For ease of review, issues addressed in this Addendum transmittal are in Blue Colored Bold text whereas previously addressed issues remain in black text. Section V— Identified Issues (Questions /Issues) 1: (Figure IA is not listed in the Table of Contents): EFCI was unable to find Figure IA in the permit document. If the Division has reviewed a copy of Figure IA, please copy EFCI or refer to the section where it is located. • The Table of Contents (TOC), List of Figures, is revised to address the removal of Figure 21; • The TOC is revised to include the correct page number for Figure 22 (Page 2.05.6 -62); • The TOC is revised to reflect the same title as on Figure 23; • (Map 9): Map 9 could not be located in EFCI's permit document, nor could it be located on the Division's Web Page using the LaserFische program. If the Division holds a copy of Map 9, please supply a copy to EFCI or refer to its location; • Discussion concerning Access Roads has been added to Section 4.03.2 of the permit; • Text in Page 2.05.6 -53a has been revised so as to properly flow to the next page (2.05.6 -54). 2: EFCI believes there may be misinterpretation of the Colorado Division of Water Resources' (DWR) regulations concerning monitoring well permits as they pertain to coal mine operations. EFCI is reviewing the issue with a consulting firm. 3: Table 15 actually pertains to `Water Rights' at Southfield. The DWR's Web Page of records and information is vast and EFCI has had difficulty locating the requested update to Table 15. Accordingly, EFCI respectfully requests a 2 week extension from the mailing date of this transmittal to update the Water Rights data for Table 15.
