8/2/13 State.co.us Executive Branch Mail - Fwd: AsOWR Tag 41- 205400 <br />This well is also known to us as Structure ID 1205400 aka denied State Engineers Well Permit Number <br />12508AD. This well permit application was an application submitted by Energy Fuels Coal Inc. in the early <br />1990's to use an existing well for mine dewatering. Our office denied this application because it was lacking a <br />Court Approved Plan of Augmentation. In the Arkansas River Basin, we have Rules requiring measurement <br />pursuant to our MEASUREMENT RULES and augmentation water pursuant to our USE RULES OF THE <br />ARKANSAS RIVER BASIN. Our staff regularly visits these wells. According to our staff notes there is no pump <br />and no power connected to the well. Additionally we have some notes that the well is not capable of being used. <br />This well cannot be used, nor any pump installed for this very reason unless meeting the above requirements and <br />enrolled in an approved plan. By the way, these plans can be rather expensive. Our office 'tags' these types of <br />well that are not allowed to pump because they failed to comply with our Rules. <br />You mentioned this well is being used for monitoring. Technically, the owner should submit an application GWS - <br />46 Monitoring Well Application and $100 fee to be approved for monitoring situations. This would not allow a <br />permanent pump to be installed in the well or water withdrawn from the well or used, only for water sampling. If <br />the owner submitted such an application we would additionally require the owner to submit information on the <br />existing construction of the well, using GWS -68. If the structure is approved for monitoring, we will continue to <br />monitor compliance with the well ensuring the Rules in the Arkansas River Basin are met. <br />If the energy company is conveying the well to the land owner, these steps would follow a GWS -11, Change in <br />Ownership form, and appropriate application for any eligible well permit. <br />Alternatively, if the structure is not capable of use, abandonment could be recommended to prevent the land <br />owner's and others groundwater from contamination. The well owner would need to do this and complete the <br />Form GWS -9 for our agency to note it is a closed well. <br />If I did not answer any question you have, please let me know.
