The ditches along the west and north sides of the RPE were also clean and <br /> stable. <br /> -The freshwater and sediment control ditches from the RPEE to the RPE pond are riprapped ditches. These <br /> ditches were well maintained and stable at the time of the inspection. The sediment ditch flows west at the bottom <br /> of the drainage (to the RPE pond) and enters a half-culvert. In May a large rock came loose from the slope above <br /> the half-culvert and crushed a portion of it. The rock has been removed and the ditch has been somewhat repaired <br /> to allow water to continue to flow until a replacement culvert arrives and is installed. There is an area below the <br /> HR-1 slide area(below this half-culvert)that is an SAE. The SAE is straw bales. The straw bales have all been <br /> replaced and the SAE appears to be functioning as designed. <br /> GENERAL MINE PLAN COMPLIANCE: <br /> -West Elk was currently mining in the E-Seam in the E4 longwall panel. They mining has progressed to station <br /> 76+00 and just passed cross-cut 40. <br /> -Development work continues in the longwall panel E5 headgate. The development was currently at station <br /> 135+20,midway between cross-cuts 70 and 71. There has been no change in the development work in the <br /> longwall panel E6 headgate(still at cross-cut 6) and the E-Seam South Mains(still at station 79+00). <br /> -Mining is progressing as permitted and shown on approved Map 51 -E-Seam Projected Operations. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 Drainage Control; Surface <br /> Stabilization;Placement: <br /> -The RPE was stable and well graded at the time of the inspection. There was no water pooling on the surface of <br /> the pile and the pile was graded to allow for adequate runoff to the perimeter ditches. There were a few piles of <br /> uncompacted refuse on the pile at the time of the inspection. The area on the east side of the pile that was <br /> excavated in the spring and early summer has been filled. He reclaimed surfaces of the RPE were well vegetated <br /> and stable and no erosional problems were noted. <br /> -The RPEE was active at the time of the inspection. The operator was hauling, spreading and compacting refuse <br /> at the time of the inspection. They were currently working on the fourth lift of the pile. There were numerous <br /> piles of uncompacted refuse on the pile but the operator was actively working the pile. The underdrain has been <br /> extended up the drainage to allow for additional refuse placement in this area. The operator was also working on <br /> the Phase IB of the rock buttress. They were using a loader and excavator to place rock on the buttress. Much of <br /> the rock is coming from rock scaling work being performed by CDOT along McClure Pass. <br /> ROADS—Rule 4.03 Construction 4.03.1(3)/4.03.2(3)Drainage 4.03.1(4)/4.03.2(4) Surfacing and Maintenance <br /> 4.03.1(5) and(6)/4.03.2(5)and(6) Reclamation 4.03.1(7)/4.03.2(7): <br /> -The road segment in Box canyon between the entrance gate and the first drill pad(for MDWs19-07 and 19-08) <br /> was well graded and stable,with no erosional problems noted at the time of the inspection. The road was steep <br /> and blended well with the surrounding undisturbed land. Slash material was placed along the road to limit access <br /> and to help control erosion. There was positive drainage on the road and no sediment was observed in the <br /> undisturbed area. There was a good amount of first-year growth with perennial grasses and forbs present. There <br /> was some Canadian and musk thistle noted on the road. This will need to be sprayed. Although not a Phase I <br /> Bond Release criterion, all of the stripped topsoil has been replaced on this road segment. No topsoil depth <br /> measurements were taken as all stripped topsoil on light-use roads is stockpiled locally and replaced to that same <br /> Number of Partial Inspection this Fiscal Year: 9 <br /> Number of Complete Inspections this Fiscal Year: 4 <br /> Page 9 of 53 <br />
