Box 187 <br />Craig, Colorado 801626 Loretta Pineda <br />Director <br />RE: Trapper Mining Inc., Permit No. C- 1981 -010; Permit Revision No. 7 (PR7) adequacy Review No. l <br />Dear Mr. Luke, <br />The Colorado Division of Reclamation, Mining and Safety (Division) received Permit Revision No. 7 (PR7) on May <br />21St, 2013. The Division deemed the application complete on May 31, 2013. The Division has completed its <br />preliminary adequacy review of PR7. Adequacy items are organized by the Rule in which they pertain and/or the <br />permit section they are in reference to. <br />Rule 2.04; Minimum Requirements for Information on Environmental Resources: <br />2.04.3 Site Description and Land Use Information: <br />1. Section 2.05 of the permit application discusses pre -mine land uses. Rule 2.04.3(2) requires the application <br />to contain a statement of the condition, capability and productivity of the land within the proposed permit <br />area. Please amend section 2.05 as necessary for the new acreage to be added to the permit area. <br />2. Please submit a map in accordance with Rule 2.04.3(2)(a) that depicts the uses of land for the additional <br />permit acreage in accordance with the land use categories established in the land use definitions in Rule <br />1.04. <br />3. Prior to any mining in the expansion area, Trapper will need to submit a narrative of the land capability and <br />productivity in accordance with Rule 2043(2)(b). The Division will stipulate the approval of this permit <br />revision to this effect. <br />4. For the proposed expansion area, please revise section 2.05 of the permit to indicate whether the proposed <br />permit area has been previously mined. If so, please submit the information required by Rule 2.04.3(3). <br />2.04.4, Cultural and Historic Resource Information: <br />On July 27, 2013 the Division received a letter from Edward C. Nichols, the State Historic Preservation <br />Officer in regards to their evaluation of the permit revision. Their letter is dated June 24, 2013 and is <br />enclosed for your review. Two cultural resources have been recorded to exist within the expansion area <br />(5MF948 and 5MF7402). A discussion of these resources is included in Mr. Nichols letter along with a <br />recommendation that a cultural resources survey be completed for those areas within the PR -7 expansion <br />area. Based on a review of the current cultural resource inventory included in section 2.9 in the permit, it <br />does not appear the entire expansion area has been evaluated. Rule 2.04.4(1) and (2) requires specific <br />cultural resource information be submitted with a permit application for areas proposed or likely to be <br />affected by surface mining activities. The permit revision does not indicate any area to be affected within <br />the proposed expansion area for the next permit term. Given this, the Division will add a stipulation to the <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
