event sulfide ore is found, and outside storage becomes an option, then steps will be taken to provide <br />the Division of Reclamation, Mining, and Safety (DRMS) with engineering designs to properly contain <br />any surface runoff water and to protect the environment consistent with the 1972 Clean Water Act. <br />lb Provide ore pad design showing area, storm water and ore capacity; and line details <br />Response: <br />Since no sulfide ore has yet been blocked out, nor is it anticipated that if any is blocked out that it will be <br />stored outside the mine. Thus, designs for its containment are not proper nor necessary for this site. <br />Proposed permit boundary modification to include existing storm water pond at toe of <br />historic mine waste <br />Response: <br />There is no existing storm water pond shown on Exhibit Map E -1A. I spoke with Tim Cazier briefly about <br />the subject on the telephone, but long enough to identify what DORMS might believe to be a storm <br />water pond. There is a level area shown at the southwest corner of the map adjacent to the highway. If <br />this is the area that has been identified, it is merely the valley bottom that has filled to the level of the <br />road culvert. The material contained within it is dominantly comprised of Cripple Creek Breccia and <br />Pikes Peak Granite on the west and historic waste rock on the east. There is no evidence that the area <br />adjacent to the highway on the west contains any purposely imported materials from mining. The area <br />identified on the map as "Historic Waste Rock Area" is the historic rock associated with the Sangre de <br />Christo Tunnel, the majority having been removed some years ago and possibly used for milling feed or <br />as decorative garden rock. The area can be included within the permit boundary if DRMS wishes, but it <br />our recommendation that the permit boundary not be changed. <br />3 The DRMS could not find storm water runoff estimates or analysis ... to demonstrate <br />adequate runoff/run -on control in the vicinity of the higher sulfide material stockpile. <br />Response: <br />As discussed in the response to Comment 1a, the project has not blocked out any ore that contains <br />"higher sulfides ", nor is it anticipated that this type of material might be found that the materials would <br />be stored outside of the mine. Thus, no special containment is necessary for something that does not <br />exist. The project has disturbed no new ground beyond the historical footprint of the mine, so at this <br />time there appears to be no new storm water management is required. We are currently in discussion <br />with CDPHE concerning permitting and will proceed toward a conclusion once a decision is made. <br />2 <br />
