Response: The most recent USFWS Colorado list and the corresponding IPaC mapping were reviewed, and it <br />was confirmed that no TES species or critical habitat (with current use) occur within the Mine Permit Area. The <br />corresponding Permit text was reviewed, updated, and revised to reflect the most recent information. <br />Rule 3.02.2 — Determination of Bond Amount <br />1) As per Rule 3.02.2(4), the amount of the performance bond required shall be adjusted for good cause as affected <br />land acreages are increased or decreased or when the cost of future reclamation changes including the cost of <br />abating any violation for which a notice of violation has been issued. <br />The bond amount for the Williams Fork Mines' Permit Renewal #6 will be addressed within a fixture adequacy <br />letter. <br />Response: MCM will review the Division's updated bond reclamation cost estimate on receipt and <br />provide any appropriate comments. <br />Rule 4.30.1 — Cessation of Operations: Temporary <br />1) Under Moffat County Mining, LLC's Application Form Renewal of 'a Valid Existing Permit to Conduct Mining <br />in Colorado, the "Current Permit Status " has been marked as temporary cessation. Currently, Williams Fork Mines <br />is listed with the Division as active. As per Rule 4.30.1(2), within 90 days after noting the Division, the permittee <br />shall submit to the Division a notice of intention to cease temporarily or abandon operations. <br />Please suhlmt to the Division a letter notitng the Division of Moffat County Mining, LLC 's intent to cease mining <br />and reclamation operations temporarily which includes the following: <br />a. The exact numher of staface acres and the horizontal and vertical extent of subsurface strata which <br />have been affected in the permit area prior to cessation or abandonment; <br />h. The extent and kind of reclamation of'surface area ivhich will have been accomplished through the date <br />of cessation or abandonment; <br />c. Identification of the backfilling, regarding, revegetation, environmental monitoring, underground <br />opening closures and water treatment activities that continue during the temporary cessation; and <br />d. A brief description of the circumstances surrounding the temporary cessation of operations and <br />anticipated date for resumption of operations, if known. <br />Response: On June 11, 2013, MCM submitted a request to the CDRMS that the Williams Fork Mines <br />be returned to Temporary Cessation status consistent with current and near -term anticipated market <br />conditions and prospects. Following review of the relevant information, the Division approved <br />MCM's request on July 7, 2013, and returned the Williams Fork Mines to Temporary Cessation status <br />Miscellaneous <br />1) Page 2.04 -4 Refers 10 117ap 11 as Regional Hydrology and Geology Map. Map 11 is the Hydrologic Monitoring <br />Program Location Map while Map 6 is Regional Geology and Hydrology Allap. Please submit an updated page <br />2.04 -4 referring to the correct map. <br />Response: The referenced page has been reviewed and revised to accurately reference the regional <br />hydrologic information. Copies of any revised pages accompany these responses for replacement in <br />the PAP. <br />
