Pineda <br />Greg Lewicki and Associates, PLLC <br />Director <br />11541 Warrington Court <br />Parker, CO 80138 <br />Re: New Horizon North Mine — Permit No. C- 2010 -089 <br />Technical Revision No. 4 (TR -04) As -Built Information for NHN -001 Ditches <br />Preliminary Adequacy Review <br />Dear Mr. Langenfeld: <br />Original designs for the sedimentation control features at the New Horizon North Mine are found <br />in Appendix 2.05.3(4) -1 (Arcadis Report on Sediment Control) of the permit. As- constructed <br />designs for Pond NHN -001 were approved with TR -0 1 on May 3, 2013. During the latter phase <br />of the TR -01 review, it was determined that as -built details of the pond's two collection ditches <br />would be appropriately handled as a separate revision to the permit. <br />An application for Technical Revision No. 4 (TR -04) was received by the Division on May 21, <br />2013. With TR -04, Western Fuels- Colorado, LLC (WFC) seeks to incorporate as- constructed <br />details for the NHN -001 West and NHN -001 East ditches into Section 2.05.3(4) of the permit. <br />The Division deemed the application to be complete, for purposes of filing, on May 23, 2013. <br />We believe that public notice of the application appeared in the May 30, 2013 edition of the San <br />Miguel Basin Forum. However, no proof of that publication has yet been received by this office. <br />Please submit Proof of Publication for the TR -04 public notice at your earliest convenience. <br />No comments or objections to this revision application have been received. <br />Your application has been evaluated for adequacy with respect to the regulations and the <br />approved permit. Items requiring your attention and response are listed below. <br />Adequacy Items <br />The Section 2.05.3(4) Table of Contents (TOC) submitted with the application is not the <br />same version that was approved with TR -01. <br />a.
