I believe
that the following language for the box on the Certificate titled, "Description of Operations/Locations/ Vehicles
..." would address these requirements:
Covers all operations in Routt and Moffat Counties, Colorado, and Carbon County, Wyoming, including
but not limited to damage from surface coal operations, the use of explosives, and damage to water
wells, as well as all activities permitted under county permit approvals.
Covered operations/properties include the Seneca 11 Mine, Seneca IIW Mine, Yoast Mine, Mesa Gravel
Pit, Red Rock Gravel Pit, Hayden Gulch Loadout, Big Elk Property, Williams Fork Mines, Foidel
Creek Mine, Peabody Sage Creek Mine, Vista Ridge and Associated Real Estate Holdings, Shoshone
Mine, and all related exploration and development activties.
Covered entities include Peabody Energy Corporation and all associated subsidiaries operating in the
noted coverage areas. In addition, those state and county governments with regulatory authority over
the covered operations/properties are included as additional insured parties with respect to General
Liability, where required by contract or agreement.
In order to meet specific county requirements we also need to include the kd|ovvng in the Certificate box tided
"Policy Holder":
Seanmlmfm
County Governments and/or County Commissioners are identified as additional insured parties with
respect to the General Liability coverage, however this coverage is limited to their interest(s) in the
operations and acti\Aties of the Named Insured, and only for such terms and limits which are the lesser
of the policies hereon, or the written requirements and/or agreements between the Named Insured and
the Certificate Holder(s).
If this language is acceptable, please re\,ise the master certificate and forward the revised certificate. Please
contact me with any questions, or if we need to discuss further. Thanks for your consideration and assistance
She also clarified that both the General Liability and Auto Liability coverage limits are for each 000urranoa, and
one not cumulative for one or multiple operations. As soon on | have o na\Ased certificate, |viU forward o copy
for your files. |n the interim, please let me know if you have any questions nr concerns about the proposed
language —
xups:llnai|ac)om|e.cvnVma|lu0l?u~2&ix~e291zmcboxiev--ptxsearcx~inbo*mh~1afea*4do4 a8a24 4/6
