7/15/13 State.co.us Eecutive Branch Mail - Re: Twentymile/Williams Forklnsurance Certificate
jnettleton@peabodyenergy.com
{
From: Musick - DNR, Jason [ mailto :jason.musick @state.co.us]
Sent: Thursday, June 20, 2013 3:25 PM
To: Nettleton, Jerry
Cc: Zach Trujillo - DNR; Alysha Hernandez - DNR; Mary Rodriguez - DNR
Subject: Re: Twentymile /Williams Fork Insurance Certificate
Thanks for the response Jerry,
understand that clarification has been made as to the Limits of the occurrences for each site. Unfortunately,
there is no reference to that information on the Certificate of Liability. When reviewing the Certificate the
Division must ensure that the Limit amounts are associated solely for each individual site. In this case, if the
Limits delineated on the Certificate represent the amounts for the Foidel Creek Mine then only the Foidel Creek
Mine with the operator Twentymile Coal LLC and the permit number should be on the Certificate. If not, then
the Division cannot make a determination as to which amounts go with which sites without requesting a copy
of the actual insurance policy to ensure that the amounts represent one site only.
This is one of the unfortunate issues when working with a policy which covers multiple operations.
Let me know what you think.
Thanks,
Jason
On Thu, Jun 20, 2013 at 11:04 AM, Nettleton, Jerry <JNettleton@peabodyenergy.com> wrote:
Jason /Zach —
In response to your questions re: our insurance certificate (06/17 e -mail) — I have been in communication with
our Bonding and Insurance Specialist, and sent her the following e-mail:
1. _ ag
https: / /mail.g oog le.conVmai I /u /0 / ?ui =2 &i k= e29129fcb5 &view = pt &search =i nboy&th= 13fe354d94138624 3/6
