the Horse Gulch Fill area, specific information regarding inspection of construction of the Horse <br />Gulch Fill and K -Pit Buttress Fill, detail regarding the timeline and phasing of the construction <br />of the Horse Gulch Fill, adjustment of the size of underdrain material to be utilized, information <br />evaluating the type of material utilized in the Horse Gulch Fill, detail in the text to describe the <br />method of underdrain core construction in advance of the dragline operation, and modified <br />figures for illustrating the anticipated construction sequence for the Horse Gulch Fill. Responses <br />to all of the Division's questions were received by the Division on June 5, 2009. The Division <br />issued its proposed decision to approve PR6 on September 21, 2009. The decision became final <br />on October 23, 2009. <br />The Division received the RN6 application from Trapper on June 20, 2012 and found it complete <br />on June 29, 2012. Public Notices were published in the Craig Daily Press for four consecutive <br />insertions beginning on July 9, 2012 and ending on July 30, 2012. The Division sent a <br />preliminary adequacy review letter dated August 21, 2012. This letter requested corrections to <br />updated ownership and control information submitted with the RN6, an updated reclamation cost <br />estimate, updated mining and reclamation plan for the next permit term, updated Threatened and <br />Endangered Species information, and several textual and map updates for the next permit term. <br />The Division sent a second adequacy review letter dated October 23, 2012. After several <br />discussions between Trapper and the Division staff, many of the adequacy review questions cited <br />in the August 21st, 2012 letter are to be addressed in a forthcoming permit revision. The second <br />adequacy review letter shortened the number of adequacy review questions from the first <br />adequacy letter to those items that were critical for the permit renewal. Trapper responded to the <br />Division's adequacy items on November 16, 2012. <br />The Division sent a third adequacy review letter to Trapper on December 4, 2012. Four items <br />were identified with this letter. The first item discussed a technical update occurring with the <br />Applicant Violator System (AVS) and notified Trapper that the Division was unable to verify <br />and update the owner and controller information they submitted on November 16, 2012. Once <br />the AVS system was functional the Division was able to verify and update the required <br />information and no additional items in regards to the owner and controller information was <br />identified. The second identified a new topographic feature on Sheet 1 of Map M12; Post Mine <br />Topography map, which would need to be revised through a technical or permit revision given <br />the nature of the change. The proposed revised Sheet 1 of Map M12 was not approved. The <br />third item identified that Trapper proposed haul road construction, topsoil stripping and mining <br />in the next five year permit term in areas that are currently outside of the Drainage and Sediment <br />Control Plan boundary. An updated drainage and sediment control plan would need to be <br />submitted in the form of a technical or permit revision. The Division suggested this item be <br />addressed with the forthcoming permit revision and would propose to stipulate the approval of <br />the permit renewal so that disturbance could not occur outside of the currently approved <br />Drainage and Sediment Control boundary depicted on Map M51 until Trapper submitted and <br />received approval of a revision of an updated Drainage and Sediment Control Plan and Designs <br />to account for the additional disturbance. The fourth item is in regards to post mine drainage <br />reestablishment and stabilization. Similar to the third item, this issue will need to be addressed <br />in the forthcoming permit revision.
