2) During the pre- operational inspection, the Division observed <br />the culvert along the Frenchman Creek crossing for the access road. <br />Based on what was observed at the time of the inspection, it appears <br />to be undersized to handle designed flow for a general storm water <br />permit. It appeared to be almost plugged from the recent storm <br />events. The operator must commit to routine maintenance after a <br />precipitation event that generates flow through the culvert or provide a <br />properly sized designed culvert to handle at least the 10 year 24 hour <br />event for Frenchman Creek. <br />The operator commits to routine maintenance after precipitation events <br />that generate flow through the culvert. <br />6.4.13 Exhibit M - Other Permits and Licenses <br />Under the exhibit the operator states, "A storm water management plan will <br />be prepared for this pit if there is a potential for surface water leaving the <br />site ". Given its location there is a high rate of probability that under a set <br />precipitation event, the potential exists for affected drainage to leave the site. <br />The Division recommends the operator obtain a general storm water permit <br />from the Colorado Department of Public Health and Environment. Please <br />acknowledge. <br />I have obtained the required forms from the Colorado Department of <br />Public Health and Environment and am submitting same for a general <br />storm water permit at this site. <br />I am attaching a copy of the Proof of Posting Notice, the Proof of <br />Publication, and Proof of notice to landowners. <br />
