restrictions described in Table F1, Appendix F of EA. The Design Features (see Section
2.2.8) of the Proposed Action would minimize effects to this species and include no
surface disturbance within 0.6 mile radius of a Gunnison sage- grouse lek. Timing
limitations for Project occupation, noise, and operations would be applied within 4 miles
of active leks. Drill site locations will be monitored for reclamation success as well.
In addition the following mitigation measure will minimize potential effects:
If and when the Gunnison sage - grouse species is listed, the BLM would initiate
consultation with the USFWS on the Proposed Action in accordance with Section 7 of the
Endangered Species Act. RM Potash may be required to stop activities in critical habitat
until consultation is completed. Once consultation is completed, RM Potash would
adhere to any additional conservation measures identified by the USFWS through the
consultation process. (EA at 67).
10. Whether the action threatens a violation of a Federal, State, or local law or
requirements imposed for the protection of the environment.
The project does not violate any Federal, State, or local law or requirement imposed for
the protection of the environment. State, local, and tribal interests were given the
opportunity to participate in the environmental analysis process. Furthermore, letters
were sent to 33 Native American tribes concerning consulting party status, few responses
were received, and no concerns were raised which were not already addressed by project
design features or mitigation measures.
Connie Clementson Date
Field Manager
Tres Rios Field Office
