Everist requests an Acreage Release for completed reclamation work in the Hill - Oakley and Fort Lupton East <br />phases of the Fort Lupton Sand and Gravel Mine, # M- 1999 -120. The City of Aurora will take over the completed <br />phases for final beneficial use as water storage reservoirs. <br />Substantial reclamation has been completed in both phases since 2011, including the slurry wall liners, backfilling, <br />sloping, and grading of the sites. The slurry wall liners of both phases passed the leak tests required by the <br />Colorado Office of the State Engineer (SEO) and have continued to meet the SEO design standard. Copies of <br />the two SEO approval letters are attached for your reference. The final piece of reclamation required for acreage <br />release - initial seeding - was completed for the 14 acres around the upper reaches of the reservoirs in April -2012. <br />A copy of the seeding invoice is also attached for your reference. <br />L.G. Everist modified our reclamation permit with the Division of Reclamation, Mining, and Safety (DRMS) permit <br />on the Fort Lupton site with Technical Revision TR -04, in 2009. The revision states, "Modify final vegetation <br />standard to allow release pnor to full vegetation establishment, all other reclamation standards remain in effect " <br />In relation to that modification, L.G. Everist is submitting an acceptance letter from the City of Aurora accepting <br />the reclaimed phases as is, and this gives the DRMS the confidence that the released acreage will be taken over <br />by a responsible party. <br />As you know, L.G. Everist requested surety reduction upon the completion of the substantial reclamation, and you <br />inspected and approved of it in Feb -2012. When the recent permit amendment was approved and the financial <br />warranty (bond) was recalculated in Oct -2012, it took into account the substantially finished reclamation of these <br />phases. Therefore, we are not requesting any surety release with this acreage reduction request because the <br />amount of bonding for the seeding would be minimal <br />A Partial Release Map is attached for a visual reference to the two phases being released.
