-3—
6.4.6: Exhibit F — Reclamation Plan Map:
RESPONSE: Attached
6.4.7: Exhibit G — Water Information:
June 26, 2013
RESPONSE: Substitute Water Supply Plan approval as of May 28, 2013,
is attached.
6.4.12: Exhibit L — Reclamation Cost:
RESPONSE: Permitee will assist in any way in the calculation of the
financial warranty and will comply with all financial requirements.
6.4.19: Exhibit S — Permanent Man-made Structures:
RESPONSE: Attached is an executed and notarized Compensation
Agreement with Donald and Jeanne Off located at 10495 E. 120" Ave. 12150 Brighton
Road Henderson, CO 80640.
Based upon our calculations, this property is the only man-made permanent
structure located within 200 feet that could possibly be affected by this operation. The
previous residences named in earlier Amendments either no longer exist, or were,
perhaps, located within 200 feet of the activity contemplated by those amendments
(primarily the construction of an access road across the Fulton Ditch). The properties
identified on the south side of 120th Avenue are not within 200 feet, however any
compensation agreements with prior structure owners will certainly be honored. Any
Compensation Agreements reached with the utilities named in previous Amendments are
deemed to be in full effect, however we do not believe that they could in any way be
deemed a structure within 200 feet of the proposed activity.
Sincerely,,"
uric $: enster
Managing Partner
EBF /cmr
CC: James Newman, GSL / Brush of Ill.
